By connecting to this network, you agree to be bound by this Acceptable Use Policy (AUP). If you cannot agree to this policy, you must not connect to the PierToPier.net wireless network. In the text below, the terms USER and CUSTOMER refer to a user of the PierToPier.net wireless network, and the term SERVICE refers to the PierToPier.net wireless network and associated services. The term OPERATOR refers to the volunteer operators of PierToPier.net, and the sponsors who have contributed to the network.

This AUP is in two parts. The first part contains terms laid down by the OPERATORS of PierToPier.net, and governs the conduct of USERS connected to the SERVICE. The second part is the AUP of our ISP, Moving-Edge. PierToPier.net is bound by these terms just as any of Moving-Edge's other customers, and as such we are obliged to ensure that the USERS of the SERVICE comply with them.

The bottom line is this - if USERS of PierToPier.net persistently abuse Moving-Edge's AUP, Moving-Edge may exercise it's right to withhold or curtail Internet services to PierToPier.net, which will ruin things for everyone. If everyone "plays nice", PierToPier.net will thrive and grow!

Acceptable Use Policy, part One - Terms laid down by PierToPier.net

1. By agreeing to this AUP, USERS of PierToPier.net accept that the SERVICE is provided by unpaid volunteers, who all have other "day jobs". This means that:

  • We cannot provide 24x7 support or monitoring of the SERVICE. Any problems will be any dealt with as soon as we have time to spare.
  • Support to users is provided solely through our forum. There is no telephone support.

2. The OPERATORS will do their utmost to provide a reliable, stable service. However, USERS of the SERVICE accept that:

  • The SERVICE may become unavailable at any time, and without notice. If this happens, we will endeavour to restore the SERVICE as soon as we can.
  • The OPERATORS cannot take any responsibility for any user data traversing the SERVICE. We cannot guarantee that your data will not become lost, damaged, or intercepted in transit. We cannot take responsibility if you lose an email or a download or any other kind of transmission, or if someone gains access to your passwords, or for any other like circumstances.
  • Security of the USER'S equipment and data is not the responsibility of the OPERATORS. It is the USER'S responsibility to safeguard against the risks of hacking, viruses, eavesdropping, and all other such hazards. The OPERATORS are not liable for any kind of loss or damage whatsoever.

3. PierToPier.net is provided by the community, for the community. As such, it is necessary to use the SERVICE in a "community-minded" manner. In order to provide a "fair" service for everyone, the OPERATORS reserve the right to:

  • Bar access to the SERVICE to anyone who is deemed to be in breach of this AUP, or is behaving in an unsociable manner (for example by consuming all available bandwidth for themselves), or for any other reason.
  • Block access to any network protocols that are deemed inappropriate or may contravene Moving-Edge's AUP. Such network protocols include but are not limited to those used by filesharing applications such as KaZaA, eDonkey, and Napster.
  • Apply any such traffic shaping as is deemed necessary to provide the SERVICE in a fair and stable manner.

4. USERS of the SERVICE agree to keep their activities legal and in good taste. USERS are forbidden to use the SERVICE for the transfer of copyrighted or offensive materials, or any other such articles.

5. Owners of bars or other venues in range of the SERVICE may advertise the presence of the SERVICE in order to attract trade PROVIDED THAT the SERVICE is advertised as PierToPier.net. Any other branding of the SERVICE is strictly forbidden.

6. Any owners of bars or other venues in range of the SERVICE who advertise the presence of the SERVICE in order to attract trade MAY NOT levy any kind of charge for the use of the SERVICE. PierToPier.net is to be provided free of charge under all circumstances.

7. The OPERATORS reserve the right to alter the terms and conditions stated in this document at any time and for any reason.

Acceptable Use Policy, part Two - Terms laid down by Moving-Edge

The CUSTOMER acknowledges that MOVING-EDGE provides the telecommunications network facilities underlying the SERVICE provided. The use of MOVING-EDGE's telecommunications network facilities is subject to the following terms, breach of which may result in suspension or termination of the end-user's right to use the SERVICE:-

1. The MOVING-EDGE network may only be used for lawful purposes. Transmission of any material through the Moving-Edge network, or use of any part of it, in violation of any UK law or regulation is prohibited. Such prohibited transmission might include, but is not limited to: copyright material, material legally judged to be threatening or obscene, material protected by trade secret, whether or not the end user was aware of the content of the material or of the relevant law.

2. The CUSTOMER shall be issued with a password to access the services and shall take all reasonable steps to keep such password private and confidential, and ensure that it does not become known to other persons. If the password becomes known to any other person the CUSTOMER will immediately inform the SERVICE operator and the password shall be changed.

3.The CUSTOMER shall not knowingly use the service for transmission of computer viruses, for transmission of any material which is defamatory, offensive or abusive or of an obscene or menacing character, or which may cause annoyance, inconvenience or needless anxiety, or for the posting of any such material to bulletin boards or newsgroups in a manner which constitutes a violation or infringement of the rights of any person, firm or company (including but not limited to intellectual property rights).

4. The CUSTOMER acknowledges that MOVING-EDGE is unable to exercise control over the content of any information passing over the MOVING-EDGE network and that MOVING-EDGE does not monitor or exercise any editorial control over the information passing over the MOVING-EDGE network. The CUSTOMER further acknowledges that MOVING-EDGE hereby excludes all liability in respect of any transmission or reception of information of whatever kind, or the accuracy of the contents thereof, or the scrambling of any information or data.

5. The MOVING-EDGE network may be used by the CUSTOMER to access other networks world-wide and the end user agrees to conform to any acceptable use policies of MOVING-EDGE and any such other networks. In addition the CUSTOMER undertakes to conform to any published Internet protocols and standards. In the event that communications by CUSTOMER do not conform to these standards, or if the CUSTOMER makes profligate use other than in accordance with this AGREEMENT of the MOVING-EDGE network to detriment of MOVING-EDGE or other MOVING-EDGE customers, MOVING-EDGE reserves the right to restrict passage of the CUSTOMER communications until the CUSTOMER complies with such standards or protocol or provides undertakings acceptable to MOVING-EDGE in respect of the CUSTOMER's future use. In the event that the end user is in breach of any provision of this schedule, MOVING-EDGE shall be entitled to suspend services forthwith without notice.
